In our last update, we noted the project was conditionally approved for the Draft Plan of Subdivision. This conditional approval was granted subject to a total of 71 conditions.
Since then, our Zoning and Draft Plan of Subdivision materials for this project were presented to council and our application was defeated and formally denied on May 7th, 2025 for non-compliance with the Official Plan and tree removal concerns.
We are looking to go through the OLT with a high success rate since we got denied after receiving a positive staff report for our application. We also believe that the City might want to settle instead of going to OLT based on their track record and so to avoid retaining external consultants for the hearing.
We have filed an appeal with the Ontario Land Tribunal (OLT) as of May 15th, received the acknowledgment letter June 11, and have the Case Management Conference/hearing on September 10, 2025. We will update partners once this conference has completed.
The city has not yet reached out regarding a potential settlement, though given past patterns, it remains a possibility. If the OLT issues a favorable decision (typically within 2 to 4 months after the hearing), we can proceed with clearing conditions for the Draft Plan of Subdivision.
